Terms and Conditions:
The following contract and its terms will set forth an agreement between:
4M Photo Booth LLC (provider) and (The Customer) whose name appears in the name field and signature section of this form. for photo booth services for an event taking place at the address provided in the "address of rental location section" This written agreement sets forth the full written intention of both parties and supersedes all other written and/or oral agreements between the parties.
SERVICE PERIOD
Provided in the "rental period start and end times" of this form. The provider will arrive approximately 1 hour before the service period begins. If you would like us to arrive earlier you will be charged for idle time. Provider agrees to have the photo booth operational for 95% of the paid period; occasionally maintenance may interrupt service, such as, changing paper or ink, adjusting cameras, etc.
PAYMENT
A non-refundable retainer in the amount of 50% of the total balance is due upon signing of this contract. The remaining amount is due 30 days prior to the event, and will be charged to the card provided on this contract unless the provider is notified with an updated form of payment. If payment is received after this date, client forfeits deposit and this agreement can be voided at the providers discretion. Valid forms of payment are checks, cash, Venmo, Zelle, MasterCard, Visa, Discover, and American Express. Once the deposit is received your date will be secured. Customer agrees to pay a $25 fee for any returned checks. Customer agrees not to dispute any charges that have been agreed to. If the rental time period exceeds the service agreement previously established, the customer will be charged $175 per hour or any portion thereof that is exceeded (Glambot® excluded). At the time of rental expiration, if the event has not ended, the customer will be asked if they would like to extend their rental. If the customer chooses to extend, a verbal contract will be acknowledged and the customer will be charged for the additional time immediately following the event either on current form of payment on file or by cash or check.
ACCESS, SPACE, and POWER REQUIREMENTS
Customer will arrange for a suitable space for the booth to be set up no smaller than 8’ wide x 8’ long x 8’ high. Customer is responsible for ensuring adequate access (within 50') to a dedicated power source with minimum requirements of 120v, 10amps, and a 3 prong outlet.
INTERNET REQUIREMENTS
Customer is responsible for ensuring there is adequate cell phone reception at the location of the rental. If no cell phone reception is available, the customer understands that 4M will not be able to offer social media uploading or emailing of photos via the digital upload station. If a digital upload station has been purchased, but there is no reception the customer is NOT entitled to a refund for the service.
DATE CHANGES and CANCELLATIONS
Any requests for a date change must be made in writing at least 30 days prior to the original event date. Change is subject to Photo Booth availability and receipt of new service contract. If there is no availability, for the alternative date, the retainer shall be forfeited and services cancelled. Any cancellation done less than 30 days prior to the event date, customer forfeits all payments received.
DAMAGE TO PROVIDERS EQUIPMENT
Customer acknowledges that it shall be responsible for any damage or loss to the 4M Photo Booth’s equipment caused by Misuse by the customer, their guests, or event staff, or any theft.
INDEMNIFICATION
Customer agrees to and understands the following: A) Customer will indemnify provider against any and all liability related to customer’s event during or after the customer’s event. Customer will indemnify provider from the time of service and post service against any liability associated with the customer, their event, the place of service, or their guests. B) Customer will indemnify provider against any and all liability associated with the use of pictures taken by 4M Photo Booth or its representatives.
MODEL RELEASE
Customer agrees and understands that any picture taken by the provider is the property of the provider and may be used for marketing or promotional materials. Customer understands that if they do not wish for pictures to be used as marketing or promotional materials, they must make that known to the provider. Customer understands and agrees that the provider retains the right to sell any enlarged or stylized images to the customer or their guests. Customer agrees that all guests using the booth hereby give 4M Photo Booth the right and permission to copyright and use photographic materials of any photo booth user who may be included intact or in any part, made through any and all media now or hereafter known for illustration, art, promotion, advertising, trade, or any other purpose. In addition, I hereby release, discharge, and agree to save 4M Photo Booth from any and all liability that may occur or be produced in taking of pictures or in any subsequent processing thereof, as well as any publication thereof, including without limitation any claims of invasion of privacy.
MISCELLANEOUS TERMS
If any provision of these terms shall be unlawful, void, or for any reason unenforceable under Contract Law, then that provision or, portion thereof, shall be deemed separate from the rest of the contract and shall not affect the validity and enforceability of any remaining provisions, or portions thereof. This is the entire agreement between the provider and the customer relating to the subject matter herein and shall not be modified except in writing, signed by both parties. In the event of a conflict between parties, the customer agrees to solve any disagreement via arbitration. In the event provider is unable to supply a working photo booth for at least 95% of the purchased period, the customer shall be refunded a prorated amount based on the amount of service received. If the printer fails to print, the provider will be allowed to give a web site to the client where guests can log on and order free prints or download digital copies.
